1. Acceptance of Terms

By creating an account, accessing, or using the Nexcasts API, dashboard, and related services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Account Responsibilities

You are responsible for maintaining the security of your account, passwords, and API keys. You are fully responsible for all activities that occur under your account, regardless of whether the activities are undertaken by you, your employees, or a third party.

• You must provide accurate and complete information during registration.
• You must immediately notify Nexcasts of any unauthorized uses of your account.
• Nexcasts will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

3. Acceptable Use & Compliance

Nexcasts provides infrastructure for enterprise communication. It is your responsibility to ensure that your usage complies with all applicable local and international telecommunications laws (including TCPA, GDPR, and local telecom regulations).

You explicitly agree NOT to use the service to:

• Send unsolicited messages or robocalls (SPAM) without explicit recipient consent.
• Transmit illegal, harassing, defamatory, or fraudulent content.
• Spoof caller IDs or misrepresent your identity to recipients.
• Bypass rate limits or attempt to exploit vulnerabilities in our API.

4. Fees & Payments

Our services are provided on a prepaid wallet or subscription basis. By adding funds to your Nexcasts wallet, you authorize us to deduct charges for the calls and SMS messages you process through our platform.

• Rates are subject to change based on carrier pricing; we will notify you of significant changes.
• All payments are non-refundable unless otherwise required by law.
• If your wallet balance reaches zero, active campaigns will be paused until funds are replenished.

5. Limitation of Liability

In no event shall Nexcasts, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

6. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
